The Policy, Practice and Learning Working Group is preparing a response with our views on the judicial review reforms beyond nationally significant infrastructure being consulted on by the Ministry of Justice.
Please let us know if you would like to be part of a small team collating the NIPA response by the end of business on 13 August. We will set up a Teams call to discuss the development of the NIPA response.
We would particularly welcome NIPA Members with experience or knowledge of legal challenges against major infrastructure projects consented under the Town and Country Planning Act 1990 (TCPA 1990) and the Transport and Works Act 1992 (TWA 1992) regimes.
As background, NIPA submitted a response to the call for evidence on the recommendations of the Independent Review of Legal Challenges to Nationally Significant Infrastructure Projects led by Lord Banner KC in December 2024, as noted in the list of respondents set out in Annex A of the consultation document.
The aims of this consultation are:
- To assess whether there are current or anticipated issues with delays to major infrastructure projects consented under the TCPA 1990 and the TWA 1992 regimes which are caused by legal challenges and which may be mitigated with changes to the judicial review process; and
- To determine how reforms should be targeted to support delivery of these developments, while ensuring access to justice and avoiding undue burden on the courts’ resources.
The Government is looking for evidence on the potential benefits of further targeted judicial review reforms, as well as any potential risks or practical implications, to inform the development of future policy.
