
Online Call: NIPA Response to Ports NPS Consultation and Transport Committee Call for Evidence

NIPA will be responding to the consultation on the Ports NPS and the Transport Select Committee's Call for Evidence on the same and we would welcome input from members on the key points you would wish to see NIPA making.

Some initial points for the response being considered are as follows:
- that/whether we welcome the overarching approach to need in the revised NPS;
- that the NPS should reference the important role that ports will play in delivering the CCS Vision;
- given the HRA implications for many ports, and the need case potentially leading to lots of scope for alternative solutions arguments, do we agree that we should be advocating for the Ports NPS to give the benefits of CNP status found in NPS EN-1 to port developments (and should that apply to all port developments, or just those supporting energy CNP infrastructure);
- do we consider there are any inconsistencies with the NPSNN or NPS ENs;
- the revised text on section 35s should be revised, simply to make it clear that the NPS does apply to section 35 projects;
- querying how applicants would be able to show that ‘every effort should be made to embed the principles of good design in the development of port schemes’; and
- that the wording on complying with the National Landscapes duty is potentially onerous and still leaves a lack of clarity on what the s.245 duty actually means in practice.
